What Is Prior Art in Patent Law?

A plain-English explanation of prior art, why dates matter, and how patents, publications, products, and public disclosures can affect patentability.

Prior art is information that existed before an invention's relevant filing or priority date and can be used to evaluate whether a patent claim is new or obvious.

It is one of the central concepts in patent law.

Prior Art Can Be Many Things

Prior art is not limited to patents. It can include:

  • issued patents
  • published patent applications
  • journal articles
  • technical papers
  • standards documents
  • product manuals
  • public websites
  • conference presentations
  • public sales or uses
  • videos or catalogs

If the information was publicly available at the right time, it may matter.

Why Dates Matter

A reference usually matters only if it is old enough. Patent analysis often turns on filing dates, publication dates, priority dates, and public disclosure dates.

For example, a patent publication from 2024 may not be prior art against an application filed in 2021. But a provisional application, foreign priority document, or earlier publication could change the analysis.

Prior Art and Novelty

Novelty asks whether one prior art reference discloses every element of a claim. If one reference teaches all required elements, the claim may not be new.

Prior Art and Obviousness

Obviousness asks whether the claimed invention would have been an obvious variation or combination of what was already known. This can involve multiple references.

Why Prior Art Search Is Hard

People use different words for the same idea. Older references may use older vocabulary. A relevant disclosure may appear in a figure, an example, a paragraph deep in the specification, or a dependent claim.

Patent Bear helps by keeping search, reading, figures, notes, chat, and labs in one workspace. You can find references, inspect the actual support, save what matters, and build structured comparisons.

Prior art is not just a document. It is a dated disclosure that must be compared carefully against the claim or invention at issue.

Search prior art with source review

Find patents, publications, and technical literature, then inspect the exact evidence before relying on it.
