How Do I Search for Prior Art?

Prior art search is broader than patent search. Learn where to look, how to search, and how to organize references for novelty or validity analysis.

Prior art is any public information that existed before a relevant date and may affect whether a patent claim is new or non-obvious. It can include patents, patent applications, technical articles, standards, product manuals, websites, videos, public sales, and more.

Patent documents are usually the best starting point because they are structured and searchable.

Define the Target

Before searching, identify what you are testing:

  • an invention idea
  • a pending application
  • a patent claim
  • a product feature
  • a competitor patent

If you have claims, break them into elements. If you only have an idea, break the idea into features.

Search Patents and Publications

Use keyword searches, classification searches, assignee searches, inventor searches, and citation chasing. Start broad, then narrow.

Look for references that disclose the same problem, structure, steps, or result. A perfect title match is rare. A good figure or claim match is more important.

Search Non-Patent Literature

Some fields rely heavily on articles, standards, manuals, or academic papers. Software, biotech, medical devices, wireless standards, and industrial processes often require non-patent literature searching.

Compare Element by Element

For serious prior art work, the question is not "does this look similar?" The question is whether the reference teaches each claim element, alone or in combination with other references.

That is where a claim chart or matrix helps.

Use Patent Bear's Prior Art Analysis

A Patent Bear Prior Art analysis can search patents, publications, and technical literature, then organize results into element-by-reference mappings. You can review the chart, inspect the evidence, edit the work, save it, and return to it from the library.

Prior art search is not just finding documents. It is building a defensible explanation of why those documents matter.
