Before You Build Around a Competitor, Read Their Continuations
Designing around one issued patent may not be enough. Pending continuations can change the risk picture for founders, product teams, and FTO counsel.
Designing around an issued patent can feel like solving the problem.
Sometimes it is not.
If the competitor has pending continuations, the claim picture can still move. A continuation may pursue claims that are closer to your product than the issued patent you just studied.
That does not mean you should panic. It means you should read the family.
The Issued Patent Is One Snapshot
An issued patent shows claims that were allowed at one point in prosecution. It does not necessarily show every claim the applicant might pursue in related applications.
Continuations let applicants seek different claim scope based on the same disclosure. For FTO and competitive strategy, pending continuations can be as important as issued claims.
Check the Family Before You Relax
When reviewing a competitor patent, ask:
- Is there a pending continuation?
- Are there child applications?
- Did the applicant file a continuation before issuance?
- Are claim terms shifting across the family?
- Do pending claims move toward your implementation?
- Is the specification broad enough to support claims around your design-around?
The answer may change the risk assessment.
Design-Arounds Need Monitoring
A design-around is not a one-time event if the family is active. Product teams should monitor pending claims, office actions, and amendments in important competitor families.
This is especially true when the competitor knows the market direction and is actively prosecuting claims.
Use Patent Bear to Follow the Chain
Patent Bear helps by showing continuity context, application links, patent records, figures, claims, file history, notes, and saved matters in one place. That makes it easier to keep a competitor family under review without rebuilding the context every time.
Do not just read the patent. Read the family.
Check the family before designing around
Search a competitor record and inspect continuations, related applications, claims, and file history in one place.
